Terms and Conditions

• The Applicant should provide all of the information requested above for his/her application for the Advisory Service. Should any of such information are considered insufficient or unclear by HKTDC, HKTDC may refuse the Applicant’s application for the Advisory Service.
• Upon acceptance of the Applicant’s application, a maximum of one free Advisory Service session may be arranged per Advisory Area and the duration of such consultation session would not be more than 45 minutes. The Applicant undertakes to notify the HKTDC in writing at least 3 working days before the Advisory Service session if he/she wishes to cancel or reschedule the appointment. Late attendance, absence without the foregoing prior written notification or reasonable explanation accepted by HKTDC will result in a 1-year suspension from applying for any future free Advisory Service. Any appointment can only be rescheduled once.
• No solicitor-client or other professional-client relationship is created between the Applicant and the Advisor pursuant to the Advisory Service and lawyers or other professionals from the same firm of the Advisor are not precluded from undertaking any new clients or continuing the representation of their clients with interests adverse to or conflict with the Applicant, his/her company or partners. Neither is there any business, fiduciary or other special relationship created between the Applicant, his/her company or partners and HKTDC and/or their employees, officers or agents by virtue of the application for and/or use of this Advisory Service.
• The Advisor will only provide verbal advice during the Advisory Service and recording by whatever means (except written notes the Applicant may take) during the Advisory Service session is strictly prohibited. The Advisor may refuse to provide any advice or terminate the free Advisory Service on the basis of conflict of interests or any other reasons.
• All information (except for publicly known information) disclosed by the Applicant for the purposes of consultation and all communications between the Advisor and the Applicant in the course of consultation shall be held in strict confidence.
• Notwithstanding the above, HKTDC shall have the right, at its sole and absolute discretion, to accept or refuse any application for the Advisory Service and make any arrangements relating to the Advisory Service session. In case of any disputes over the Advisory Service, the decision of HKTDC shall be final and binding.

• The advice, opinion, comments, statement, analysis and/or suggestion provided by the Advisor pursuant to the Advisory Service (the “Advice”) shall be based on the limited information provided by the Applicant for the purpose of consultation. The Advisory Service is provided by independent Advisors in the relevant fields of Advisory Areas. The HKTDC, its officers, employees or agents makes no express or implied guarantee, representations or warranties as to the accuracy, completeness or reliability of any Advice provided by the Advisors pursuant to this Advisory Service or any other aspects of the same. Without limiting the foregoing, HKTDC does not warrant that the Advisory Service will be error-free or will meet any particular criteria of performance or quality.
• The Advice provided by the Advisor pursuant to this Advisory Service is for general guidance and shall not constitute formal legal or other professional advice nor replace or serve as substitute for any such formal legal or other professional advice and service in the relevant Advisory Areas. Such Advice provided by the Advisor should not be used or relied on for making decisions. The Applicants choose to use or rely on any such Advice are responsible for making their own assessment and should do so at their own risk, and they should not be relied upon without consulting formal professional advice in the relevant Advisory Areas. The Applicants should obtain specific professional advice.
• HKTDC and the Advisors expressly disclaim any and all liability arising out of including without limitation any inaccuracies, incompleteness, mistakes or errors in, or omissions from the Advice pursuant to, related to or arising from the Advisory Service. In no event will HKTDC and the Advisors be liable for any claim, or any direct, indirect, special, incidental or consequential or exemplary damages of any kind (including without limitation any loss of profits or business), without regard to the form of any action, including but not limited to contract, negligence or other tortuous actions, arising from or in connection with any use or reliance of such Advice provided by the Advisors or pursuant to, related to or arising from the Advisory Service.
• Notwithstanding and without prejudice to the above and to the fullest extent permitted by law, the aggregate liability of HKTDC to any Applicant or any third parties for all or any claims arising from or relating to the Advisory Service shall be limited to the amount of HK$1,000. The Applicant agree and accept that this is a material consideration in HKTDC’s decision to provide the Advisory Service free of charge and therefore, this limitation of liability is a fair and reasonable under the circumstance and the Applicant shall not contest the same.
• In the event of any inconsistency between the English and Chinese versions, the English version shall prevail
